The process of filing for probate can be challenging, especially after the loss of a loved one. The Family will need to choose an Executor of the estate, whose duty is to make sure Creditors are notified in a timely manner, financial records are kept organized, and the assets of the estate is distributed among the heirs according to the will.
Depending on the size and the complexity of the estate will help you determine if you need an Attorney or not. With large complex estates, it is recommended that you seek a Probate Attorney. With a small estate the Executor can file a petition with the Probate Court to begin the process.
