The process of filing for probate can be challenging, especially after the loss of a loved one. After the passing of my Mother, in 2021, I found myself tasked with the duty of filing for probate with my County. I searched for information online, to start the process of filing for probate with our County Court.
Each State has its own set of laws and types of probate that can be filed. First, you have to decide what category the descendant falls under. It can either be Intestate, where the descendant did not leave a valid will. Then you have Testate, where the descendant left a valid will and instructions for the family to follow. The Family will need to choose an Executor of the estate, whose duty is to make sure Creditors are notified in a timely manner, financial records are kept organized, and the assets of the estate is distributed among the heirs according to the will.
Depending on the size and the complexity of the estate will help you determine if you need an Attorney or not. With large complex estates, it is recommended that you seek a Probate Attorney. With a small estate the Executor can file a petition with the Probate Court to begin the process.
